The EURES ITALY team 

Foreign workers are on an equal rights with Italian citizens in the enjoyment of specific rights related to work, and therefore: health and safety at work; equal opportunities between men and women; protection against all forms of discrimination; the right to fair and proportionate remuneration; the right to reconcile work and family life; the right to rest and to join (and not join) a trade union. 

In addition, all the rights expressly provided for in your employment contract or in the national or territorial collective agreement of reference for your sector of work are also provided for. 

During the selection process, the employer is not allowed to ask questions about political and religious opinions, pregnancy or HIV status, marital status or family status (principle of non-discrimination).

How many hours a day can you work? 

Normal working hours are set at 40 hours per week, but reference is made to collective labor agreements, at a national or setolar level; resort to overtime is possible, but must be limited. 

The worker is entitled to 11 consecutive hours of rest every 24 hours and a rest period of at least 24 consecutive hours, usually coinciding with Sunday, every seven days. Paid annual leave must last at least four weeks and is non-renounceable.

What does undeclared work mean (labor exploitation)?

According to Italian legislation, labor exploitation occurs when certain characteristics are present in the performance of the work activity, such as: 

• Payment of wages that are below national standards and disproportionate to the hours worked;
• Repeated prolonged working hours or the denial of weekly rest, paid annual leave and/or paid sick leave;
• The systematic violation of workplace safety and health;
• The use of degrading methods of supervising the worker.

What are the employer's obligations in order to safeguard the worker's job security? 

The obligatory fulfilments (D. Lgs. 81/2008) assigned to the employer are many, among which: 

• The assessment of all the risks present in the workplace to which workers could be exposed with the consequent elaboration of the Risk Assessment Document (Dvr);
• The implementation of standards for premises, plant, machinery and equipment;
• The organization of the prevention and protection service;
• The appointment of the indispensable figures for safety at work;
• The information, education and training of workers; 

These activities must not, under any circumstances, involve financial costs to workers. The supervision of these activities is the responsibility of INAIL, which you can contact for more information.

Where can workers turn to find out if they are in an exploitative work condition? 

 There is a wide network of support, information and orientation on the national territory: it is possible to contact trade unions, trade associations, territorial services of the municipality of residence, as well as associations

Who can the worker turn to in case of an emergency? Or for information? 

The worker can call the national anti-trafficking hotline 800.290 290. 

The number is free and active 24 hours a day, every day of the year. The operators who answer are linguistic-cultural mediators who speak English, Spanish, Albanian, Romanian, Russian, Moldovan, Ukrainian, Nigerian, Chinese, Polish, Portuguese and Arabic. 

They provide useful information and orientation to local services or, in case of emergency, assistance for specific needs. As part of the awareness-raising activities carried out by the Department for Equal Opportunities, there is also a website that has a special section dedicated to labor exploitation.

What is “Caporalato”? 

The "caporalato", or illicit work intermediation, is a system that recruits workers to work for third parties, in conditions of exploitation. 

Caporalato is a crime, for which both the person who recruits (the caporale) and the person who "uses, hires or employs manpower" (the employer) are liable, subjecting the workers to exploitative conditions. • On the other hand, the worker is not punished for the mere fact of working without a contract or without a residence permit.

Definita la nuova procedura informatica per datori di lavoro e lavoratori. La nota sul Portale Servizi del Ministero dell'Interno

Passaggi Operativi:

1. A seguito di rilascio del visto da parte del Ministero degli Affari Esteri e della Cooperazione Internazionale (MAECI), il datore di lavoro riceve una PEC all’indirizzo indicato in domanda ai sensi dell’art. 47 c.c., con la quale viene avvisato del rilascio del visto e delle modalità procedurali attraverso le quali dovrà comunicare allo Sportello Unico per l’Immigrazione (SUI) la data dell’avvenuto ingresso in Italia del lavoratore straniero.
2. Con l’effettivo ingresso del lavoratore nel territorio nazionale, il datore di lavoro /richiedente dovrà accedere all’Area riservata del Portale Servizi ALI (https://portaleservizi.dlci.interno.it/AliSportello/ali/home.htm), sezione "Sportello Unico Immigrazione" - “Ricerca domanda”, selezionare la domanda di riferimento (che si trova nello stato “Registrazione dello straniero”), cliccare sull’icona “Inserisci dati frontiera» ed inserire le informazioni richieste: punto di ingresso/frontiera (provincia e comune italiani), data di ingresso sul territorio nazionale e numero di visto rilasciato al lavoratore straniero. Dovrà poi digitare il tasto «Trasmetti» per informare lo Sportello Unico per l’Immigrazione (SUI).
3. Con l’inserimento delle informazioni, lo Sportello Unico per l’Immigrazione (SUI) competente è automaticamente informato sull’applicativo SPI 2.0 dell’ingresso del lavoratore.
4. Il datore di lavoro riceve, contestualmente, una PEC che riporta, in allegato, il codice fiscale definitivo assegnato al lavoratore straniero.
5. Successivamente, il datore di lavoro riceve una ulteriore PEC, recante in allegato il contratto di soggiorno da sottoscrivere digitalmente, ai sensi dell’art. 22, comma 6 del D. Lgs. n 286/1998.
6. Il contratto, sottoscritto dal datore di lavoro e dal lavoratore straniero nelle modalità previste dalla norma suddetta, dovrà essere trasmesso al SUI, effettuandone il relativo caricamento nel Portale Servizi ALI, nell’ambito dell’Area riservata - sezione "Sportello Unico Immigrazione" - “Ricerca domanda”, selezionando la domanda di riferimento (che si trova nello stato “Registrazione dello straniero”) e cliccando sull’icona “Upload contratto di soggiorno firmato digitalmente” . Occorre poi digitare il tasto «Invia» per trasmetterlo allo Sportello Unico per l’Immigrazione (SUI).
7. Il contratto è reso automaticamente visibile allo Sportello Unico per l’Immigrazione (SUI) competente, che provvede alla verifica nell’ambito dell’applicativo informatico in uso, effettuandone la validazione.
8. Nella PEC con la quale viene trasmesso il contratto di soggiorno, viene anche chiarito che, se ricorrono i presupposti normativi per la sottoscrizione dell’Accordo di integrazione, il sistema informatico renderà disponibile nell’Area riservata del Portale Ali, contestualmente all’invio della predetta PEC, un’apposita sezione, nella quale dovranno altresì essere riportati i dati necessari alla generazione del predetto Accordo per la firma da parte del lavoratore.
9. In tal caso, nell’ambito dell’Area riservata del Portale Servizi ALI, sezione "Sportello Unico Immigrazione" - “Ricerca domanda”, selezionando la domanda di riferimento (che si trova nello stato “Registrazione dello straniero”), dovranno essere inseriti i dati necessari alla sottoscrizione dell’Accordo, accedendo dall’icona “Inserisci dati Accordo” e compilando la relativa maschera.
10. Una volta inseriti i dati relativi all’Accordo di integrazione, gli stessi sono visibili automaticamente dallo Sportello Unico per l’Immigrazione (SUI) competente, che dovrà provvedere alla generazione dell’Accordo stesso, tramite l’apposita funzionalità prevista nel sistema.
11. Conclusa tale operazione da parte del SUI, il datore di lavoro riceve una nuova PEC, nella quale è allegato l’Accordo di Integrazione, recante i dati inseriti nell’Area riservata, nonché la firma dell’Amministrazione. L’Accordo va sottoscritto dal lavoratore e trasmesso al SUI, accedendo dall’Area riservata del Portale Servizi ALI, sezione "Sportello Unico Immigrazione" - “Ricerca domanda”, selezionando la domanda di riferimento (che si trova nello stato “Registrazione dello straniero”), icona “Upload Accordo di Integrazione firmato” .
12. L’Accordo di Integrazione, sottoscritto anche dal lavoratore, viene reso automaticamente visibile allo Sportello Unico per l’Immigrazione (SUI) competente, che lo verifica nell’ambito dell’applicativo informatico in uso, effettuandone la validazione.
13. Acquisito e validato dal SUI il contratto sottoscritto dal datore di lavoro e dal lavoratore e, ove ricorrano i presupposti di applicazione dell’Accordo di Integrazione, acquisito e validato anche il documento di Accordo firmato dal lavoratore, l’operatore del SUI effettua le operazioni informatiche di competenza e contestualmente vengono trasmessi, tramite PEC, al datore di lavoro i Moduli 1 e 2 di Richiesta del permesso di soggiorno.
Tali modelli (1 e 2) sono altresì scaricabili dall’Area riservata del Portale Ali, contestualmente all’inoltro della PEC al datore di lavoro, e vanno consegnati al lavoratore, ai fini dei seguiti presso gli Uffici Postali e presso la competente Questura.
Con il kit di primo ingresso, comprensivo di: contratto di soggiorno firmato dal datore di lavoro e dal lavoratore, moduli 1 e 2 del modello 209, documento attestante il codice fiscale definitivo del lavoratore, documento del lavoratore e pagina recante il visto, il lavoratore potrà recarsi presso gli Uffici Postali per l’avvio della fase di richiesta del permesso di soggiorno.
Con riferimento alla busta per la spedizione, nelle more che vengano rese disponibili le buste presso gli Uffici Postali (ottobre 2025), l’acquisizione della busta stessa, necessaria a contenere il Modello 209 e la relativa documentazione associata per la presentazione dell’istanza di Permesso di Soggiorno presso gli uffici postali, dovrà avvenire in autonomia attraverso i canali commerciali dotati di materiale di cancelleria (tabaccherie, cartolerie, empori, etc.).
La busta, di formato A4, dovrà essere compilata replicando fedelmente (contenuti e posizionamento sulla busta) quanto indicato nel “layout” che sarà riportato nella pec con cui viene inviato il Modello 209. La denominazione della Questura/Ufficio di Immigrazione da indicare sulla busta è indicata in testa al Modello 209. I bollettini saranno disponibili direttamente presso gli Uffici Postali.
 

NB: Si fa presente che il contratto di soggiorno sottoscritto e l‘accordo di integrazione firmato dal lavoratore possono essere trasmessi al SUI contestualmente.
NB: Le comunicazioni trasmesse al datore di lavoro sono altresì trasmesse, per informazione, all’indirizzo mail collegato allo SPID/CIE dell’utente ( ad es. facente parte di associazioni di categoria..) che ha inserito la domanda di nulla osta nel Portale Servizi ALI per conto del datore di lavoro.
NB: Tutti gli allegati inviati tramite PEC al datore di lavoro saranno contestualmente reperibili anche nell’Area riservata del Portale servizi ALI, nella sezione «Comunicazioni».

Every citizen of the European Union has the right to move and reside freely in Italy or within the territory of another Member State other than that of which he/she is a national. Different formalities are required depending on the length of stay (exceeding three months or shorter stay).

EURES Italy - WORK IN ITALY – Info for: Non-EU national

Work in Italy is a Presidium created by the EURES Italy to provide adequate information and guidance to those who intend to have work experience in Italy for short or long term.

In EOJD events it operates mainly as an Info Point with the goal to offer a place (even virtual) to companies to meet their employment needs by meeting foreign candidates and at the same time support, both, to find the appropriate tools for a matching.

Many of EURES' services (in particular EURES on-line services) are freely available for any user with access to the web. If you already live and work in the EEA territory or Switzerland, you can contact a local or regional EURES Adviser to get advice. However, finding a job via EURES does not change the legal obligations and administrative procedures that may apply to non-EU citizens.

Non-EU nationals may have the right to work in an EU country or to be treated equally with EU nationals as regards conditions of work. These rights depend on their status as family members of EU nationals and on their own nationality. Due to complex immigration procedures, employers may as well decide not to go through your application.

If you intend to move from a non-EEA country (except Switzerland) to live and work in the European Economic Area or Switzerland, often your own Ministry of Foreign Affairs can provide you with information on legal requirements to move abroad or refer you to useful information Centre’s.

We remind you that the Italian Authority responsible for the entry and stay of non-EU citizens is the Ministry of the Interior.

If you’re not an EU/EFTA national please bear in mind that, while you may participate and apply for jobs during this event, you are still subject to immigration rules and procedures if you want to move to one of these 13 countries to work. 

Immigration policy, as well as its laws, regulations and procedures, are specific to each EU Member State.  

If you have lived for over 5 years in one of these Member States and hold a long-term resident status, you have equal treatment in that Member State to country and EU nationals, with regard to access to employment and self-employment, education and vocational training and tax benefits, for example.

In this particular case, you may be entitled to moving to another country for work. Please bear in mind, however, that this is not granted automatically, as it is subject to meeting certain conditions, namely related to labour market situation, which are defined by each Member State. As a rule, you will have to apply for and be granted a residence permit in that country before you are entitled to work there.

Seasonal work can be a job opportunity for those looking for a job for a fixed term or in any case for a short period; often has as its objective the main one is to offer young people a first work experience, not necessarily professionalizing or linked to one's own course of study and, if carried out abroad, can be a good opportunity to improve the language and learn about ways of life other than your own.

The best time to find a seasonal job in marine areas is summer; while in the mountains, in the winter sports resorts of the northern and central regions, in addition to summer the season is from November to March. In the cities of art there are good opportunities also during the Easter and Christmas holidays.

For seasonal work, the type of contract most frequently applied is that of the fixed term that the employer uses to cope with seasonal peaks of work, that is, an increase in extraordinary and occasional activities that occur in some sectors (Tourism, Trade and Agriculture) and at certain times of the year.

The Decreto Flussi (Flow Decree) is an Italian government measure that regulates the entry of non-EU foreign nationals into Italy for work purposes. It sets annual quotas for how many foreign workers can enter the country legally.
